There is No "Gadolinium Class Action" or "MRI Class Action"

People Injured by Gadolinium Contrast Agents from an MRI File Their Own Lawsuits

People injured by gadolinium-based contrast agents used during an MRI or other medical procedure often search the internet for a "gadolinium class action" or an "MRI class action."  None exist.  Instead, people who have contracted Nephrogenic Systemic Fibrosis (NSF) file a lawsuit on their own, which then may be consolidated with other people with similar injuries.

A Class Action is for a Minor Injury, Not a Serious Bodily Injury From Gadolinium

There is not an "MRI class action" or "gadolinium class action" because the class action mechanism should not be used for a person who has suffered a serious personal injury.  Class actions are a legal procedure used when many people have suffered a very small injury.  A class action is only used when an injury is so small that it is impractical for a person to retain their own lawyer.  The theory of a class action is that a large number of people have suffered an injury, but it is so small that they would not bother to seek damages for their injury on their own.  Frequently this is the case when a large number of consumers were slightly overcharged for a product or service.

Gadolinium and MRI Injuries Are Serious Enough to Justify Their Own Lawsuits

People who have developed NSF (or NFD) have an extremely serious bodily injury, completely different from a minor consumer dispute over money.  Although gadolinium lawsuits can, and have been, consolidated in some jurisdictions for pretrial matters, and may be described as mass torts, this is different from a class action because each person must prove he or she has been diagnosed with NSF/ NFD after being treated with a gadolinium-based contrast agent.  Having merely had an MRI with gadolinium contrast agent, without later developing NSF, does not support a legal claim.
