The Terms “YAZ Class Action” and “Yasmin Class Action” are Misleading

Women Injured by YAZ/Yasmin/Zarah/Ocella File Their Own Lawsuits

Women who have been injured by YAZ or Yasmin birth control, or the Yasmin generics Zarah and Ocella, often search the internet for information on a “YAZ class Action” or a “Yasmin class Action.”  There is no such thing.  Instead, women who have suffered from a YAZ side effect (or Yasmin side effect or Ocella side effect) have the right to file their own, individual lawsuit.

A Class Action is for a Small Injury, Not Serious Drug Side Effects

There is not a “YAZ class action” or “Yasmin class action” because the class action mechanism should not used for a person who has suffered a serious personal injury.  Class actions are a legal procedure used when many people have suffered a very small injury.  A class action is only used when an injury is so small that it is impractical for a woman to retain her own lawyer.  The theory of a class action is that a large number of people have suffered a very small injury, so small that they would not bother to seek damages for their injury.  This can be the case when a large number of consumers were slightly overcharged for a product or service.

YAZ/Yasmin/Zarah/Ocella Injuries Are Serious Enough to Justify Your Own Lawsuit

The injuries women can suffer from YAZ, Yasmin, Zarah and Ocella are serious bodily injuries, completely different from a minor consumer dispute.  The injuries caused by YAZ, Yasmin, Zarah and Ocella include blood clots in the legs (known as deep vein thrombosis), pulmonary embolisms (where the blood clot has moved to the lung), gall bladder disease, strokes, heart attacks, and even death.  Further, because every woman is different, the nature of her injuries and the compensation to which she is entitled are different.  Although YAZ, Yasmin, Zarah and Ocella lawsuits can (and have been) consolidated in some jurisdictions for pretrial matters, and may be called a mass tort because so many women have been injured, this is different from a class action because each woman must prove she was actually injured by YAZ, Yasmin, Zarah or Ocella and that she is entitled to recover money damages, not just that she used one of these products.
