There is No “NSF Class Action” or “Nephrogenic Systemic Fibrosis Class Action”

People with NSF Can File Their Own Lawsuits

People who have developed Nephrogenic Systemic Fibrosis (NSF) after exposure to a gadolinium-based contrast agent sometimes search the internet for an “NSF class action” or a “Nephrogenic Systemic Fibrosis class action.”  There aren’t any such class actions.  Instead, people who have developed NSF, also known as Nephrogenic Fibrosing Dermopathy (NFD), file their own, separate lawsuits.  These lawsuits may then be consolidated with other NSF/NFD lawsuits for pretrial matters, but are tried on their own.

A Class Action is for a Minor Injury, Not a Serious Bodily Injury Like NSF

There is no “NSF class action” or “Nephrogenic Systemic Fibrosis class action” because the class action mechanism should not used for a person who has suffered a serious personal injury.  Class actions are a legal procedure used when many people have suffered a very small injury.  A class action should only be used when an injury is so small that it is impractical for a person to retain their own lawyer.  The theory of a class action is that it is necessary because a large number of people have suffered an injury, but it is so small that they would not bother to seek damages for their injury on their own.  Frequently this is the case when a large number of consumers were slightly overcharged for a product or service.

NSF is Serious Enough to Justify its Own Lawsuit

People who have developed NSF (also known as NFD) have an extremely serious bodily injury, completely different from a minor consumer dispute over money.  NSF lawsuits can, and have been, consolidated in some jurisdictions for pretrial matters, and may be described as mass torts, but this is different from a class action because each person must prove he or she has been diagnosed with NSF/NFD after being treated with a gadolinium-based contrast agent.  A person who does not have NSF and was merely exposed to a gadolinium contrast agent does not have a legal claim.
