Arkansas Statutes of Limitations for NSF Claims
The State of Arkansas, like most other jurisdictions, places deadlines on when a person can file a lawsuit. These deadlines are called statutes of limitations. Arkansas residents who have developed NSF are fortunate because the Arkansas statutes of limitations that apply to their claims are a bit longer than in other states.
Under Arkansas law, the statute of limitations for negligence and strict liability actions is three years, which means that a lawsuit must be filed within three years after any injury or death caused by a defective product. By way of comparison, in most other states, the statute of limitations is only two years. Arkansas also applies the "discovery rule" to product liability claims, which means the statute of limitations does not begin to run until a person knows or by exercise of reasonable diligence should have discovered the causal connection between NSF and the gadolinium-based contrast agent, and that they have NSF.
