New Mexico Statutes of Limitations for NSF Claims
The State of New Mexico, like most other jurisdictions, places deadlines on when a person can file an NSF lawsuit. These deadlines are called statutes of limitations. New Mexico residents who have developed NSF have the benefit of statutes of limitations that are a bit longer than those of most other states.
Under New Mexico law, the statute of limitations for personal injury claims is three years, which includes negligence and strict liability. A three-year statute of limitations also applies to wrongful death claims. A four-year statute of limitations applies to a personal injury claim based on breach of an implied warranty. By way of comparison, most other states have two-year statutes of limitations. New Mexico also applies the "discovery rule," which means the statute of limitations begins to run only when a person knows, or by exercise of reasonable diligence should have discovered, both that the person has been injured and the cause of the injury. However, the discovery rule does not apply to wrongful death claims, which accrue at the time of death.
